SINGLETRACK SKILLS LLC MOUNTAIN BIKE EVENT LIABILITY RELEASE BY SIGNING THIS DOCUMENT YOU ACKNOWLEDGE THE RISKS INHERENT IN MOUNTAIN BIKING AND WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT. In this Release Agreement the term “mountain biking” includes all mountain bike activities including, but not limited to, guided descents and ascents, clinics, lessons, camps, and private instruction (hereinafter “mountain biking”). ASSUMPTION OF RISKS By signing this waiver, I acknowledge that participating in mountain biking carries inherent risks, including the risk of serious injury or death. Mountain biking takes place on a variety of terrain including rugged and challenging features, and will expose the rider and their equipment to many risks, dangers and hazards. I understand that these risks may be caused by my own actions or inactions, the actions or inactions of others participating, the condition of the equipment used, or the condition of the premises on which the mountain biking is conducted. I agree and understand that I will be held to assume the risk of all terrain and course conditions, including but not limited to weather, trail obstacles both natural and manmade, and potential collisions with other persons and wildlife. I have the right to not ride any portion of a trail or attempt any skill or maneuver that I consider to be too dangerous, risky or unsafe for a rider of my skill level. I agree and understand that I will be held to assume the risk of equipment malfunction including bike, helmet and personal riding gear. I fully assume all such risks and accept personal responsibility for any and all damages, liabilities, losses, or expenses that I incur as a result of my participation in mountain biking. Participation in mountain biking requires physical activity and the ability to handle potentially challenging terrain. By signing this waiver, I represent that I am in good physical health and able to participate in mountain biking activities. I understand that it is my responsibility to inform the instructor or coach of any physical limitations or medical conditions that may affect my ability to safely participate in mountain biking. I agree to follow all rules and guidelines set forth by the instructor or coach, and to stop or take a break as needed to ensure my own safety and the safety of others. I also understand that it is my responsibility to bring any necessary medications or medical devices with me on the ride and to inform the instructor or coach if I need to use them. I understand mountain biking carries a risk of concussions and other head injuries due to the nature of the activity and the potential for falls and collisions. It is important to recognize the signs of a concussion and to seek medical attention if a concussion is suspected. To help prevent concussions and other injuries while mountain biking, participants are required to: (1) Wear a properly fitting and certified helmet at all times while riding. (2) Follow all rules and guidelines set forth by the mountain bike instructor or coach. (3) Not ride beyond their abilities or in conditions that may increase the risk of injury. If a participant sustains a suspected concussion or other head injury while mountain biking, they are required to: (1) Report the injury to the instructor or trail coordinator immediately and cease participation. (2) Follow any and all medical advice provided by a healthcare professional. (3) Obtain written clearance from a healthcare professional before returning to mountain biking. WAIVER, RELEASE OF LIABILITY I release, waive, discharge, and covenant not to sue Singletrack Skills LLC and its officers, directors, employees, agents, and representatives (collectively, the "Released Parties") from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, arising out of or connected with my participation in the mountain bike lesson, including any such claims which allege negligent acts or omissions of the Released Parties. I understand and agree that this waiver is binding on me, my successors, heirs, and assigns. I have read this waiver and fully understand its terms. I voluntarily agree to the terms and conditions stated above. MEDIA/PHOTO RELEASE I hereby grant Singletrack Skills LLC the right to use, publish, and copyright photographs, video recordings, or other media (collectively, "Media") of me taken during my participation in mountain biking. I understand that the Media may be used for a variety of purposes, including marketing and promotional materials, social media, websites, and other forms of media. I waive any right to inspect or approve the finished product, including written copy, that may be used in connection with the Media. I waive any right to royalties or other compensation arising from or related to the use of the Media. I release, discharge, and agree to hold harmless Singletrack Skills LLC and its officers, directors, employees, agents, and representatives from any claims, demands, or causes of action arising out of or in connection with the use of the Media, including any and all claims for invasion of privacy, defamation, or violation of any right of publicity. I understand and agree that this release is binding on me, my successors, heirs, and assigns. I have read this release and fully understand its terms. EVENT CANCELLATION POLICY Singletrack Skills LLC reserves the right to cancel an event due to insufficient enrollment, adverse weather or other unforeseen circumstances. In the event of a cancellation, registrants will be offered a full refund. Participants who cancel or no show will not receive a refund. However registration transfers ARE allowed. We will allow you to transfer your registration for any Singletrack Skills event, clinic or lesson to another participant. You must submit your transfer request via email no less than 12 hours prior to the start of the event. Any monetary exchange for the registration is the responsibility of the original registrant. Refunds will be issued in the same form as the original payment. If the event is rescheduled, registrants will have the option to attend the rescheduled event or request a refund. Singletrack Skills LLC is not responsible for any expenses incurred by registrants in connection with the event, including travel and accommodation costs. Singletrack Skills LLC reserves the right to make changes to the event schedule, coaches, and other details as necessary. I have read and understand the event cancellation policy.
